What is a special needs trust?

A special needs trust is created to ensure that beneficiaries have access to certain funds held for their benefit. Beneficiaries of special needs trusts are typically persons with disabilities who will be unable to provide for themselves after a parent, sibling or other family member passes away. A trustee will be appointed to manage the special needs trust. A trust can be financially advantageous as it allows beneficiaries to hold funds without losing access to government benefits, including supplemental security income (SSI) and Medicaid health benefits.

A special needs trust may be appropriate if:

  • You are a disabled individual or you are the guardian for a disabled person and want to set aside funds
  • A child or disabled person has recovered for a lawsuit and needs to set aside funds while collecting government benefits
